The Pot Law Has Fallen.Ca

The prohibition of marijuana in Canada has fallen into legal invalidity. The purpose of this site is to inform the Canadian public of this, to explain its significance, to mount a campaign to end the enforcement of this invalidated law, and to offer pertinent information and assistance to any Canadian who may be in legal jeopardy from it. If you have been charged with the alleged offence of simple possession of marijuana, you now have a very credible line of legal defence. A legal defence along these lines succeeded in Oshawa on 2007 October 19 in persuading the judge to dismiss charges of simple possession of marijuana on the grounds that "there is no offence known to law," and this recent dismissal of charges adds weight and power to this line of legal defence. I witnessed the events in court on October 19 and sent an account of the trial to fellow activists as well as a report of the judicial proceedings to a senior prosecutor. I called on the Federal Prosecution service to stop proceeding with cases; until this takes place, Canadians accused of possession should see my legal defence kit. I was just shown this website and found it very interesting. I have a friend who is actually fighting possession charges in court right now for a pitiful amount of marijuana and is using the resources on this site as part of his defense. Looks like we have a fighting chance! |

ya obviously the random pot smoker doesn't have much to worry about in bc, but what about his/her trusty supplier???
I know guys who've had their children taken away because they were selling pot just so they could put dinner on the table for those kids. Things need to change. |

Update: 2008 April 4 New victory for our campaign, in British Columbia! I was glad to hear this week from J. Foote, whose charges of simple possession were stayed last month in Prince Rupert, B.C. He handled his own defense by printing out the legal defense kit from this website and requesting the duty counsel at court to process his plea. I'm told the duty counsel took a positive interest in the legal kit and is helping another defendant who is using it in Terrace, B.C. This latest success shows that our legal kit for defendants to make their own constitutional challenges is viable all across Canada, not just in Ontario. :) looks like it worked! |

street level pot dealers in smalltowns make just enough to keep their head above water. the only ones that don't live in low income housing and drive junker cars are the ones that hold onto legitimate day jobs. I'm not sure why he didn't work a legitimate job, it wasn't my place to ask. It just seems that selling joints to highschool skids isn't a good enough reason to take children away from their parents. |

Granted, I'm against marijuana being part of the black market in the first place, but still, from a governmental standpoint it looks bad. Yes, stupid laws make stupid things illegal, but they are still illegal and still pose danger for those involved. Just because the weed industry is weed and not coke doesn't mean that violence and other potentially harmful aspects of the black market don't get afflicted on the family. |
