Hm.. Question? Any Ideas?
Okay, so i don't know if any of you would kno n e thing bout this but....
i was arrested fer possesion of under 40 grams (misdemeanor) and they wrote me a ticket, then took me ta tha police station and fully booked me... fingerprints.. picture... everything... and on the ticket it said that i would have my arrainment on the 29th... so im all hella nervous right and trying to figure out what ta do, get a public defender or some shit cuz i cant afford a lawyer... so i call the city municipal court for tha place it happened (where i used to live) and they say they have no records of any such incidence being filed... i lived on bainbridge island which is like pretty small so there isnt much for tha po ta do... but i have a hard time believing that they would go to all that trouble just to scare me... the woman at the court told me to call the procesuter's assistants office and so i did and left a message... but if SHE doesn't have ne info, does that mean its just like it never happened at all? is there somewhere else i need to check? i dont know what to do seeing as its this coming monday.. advice/ ideas n e 1......?

the ticket is most likely to scare you. they probably didnt have anything else better to do that night.
if you were really arrested and charged and they dont have your name in the courts then probably they're in theprocess of putting you through the alternate measures program which usually just consists of community service and maybe some little shit thing on the side (i also had to write an essay *rolls eyes*). if thats the case, you should be gettin a letter in teh mail tell you that.

i just found out that it DID get filed... and now i have to go for an arrainment on monday... which isnt even to tell them if im guilty or not, basically its just to tell me what EXACTLY im being charged with and what my options are... then i have to apply for a public defender cause i cant afford lawyers cause im broke and i dont want my parents to pay fer it cz its my own fault...
and its not like i just "got caught" okay? seriosusly... my friend backed into my car in a aparking lot... then the whole front of my car got fucked up... (my man's car actually) and broke one headlight and bent tha hood and pushed in the grill... so this cop happens to pull in the parking lot and we are just about to leave after we make sure were all okay... when he comes over and stops us... he says " you have over 150 $ in damage that means u HAVE to file a report..." im like oh OKAY... great.. so im lookin for my license when he's all.. "step outta tha car ur under arrest fer possesion" im like oh shit... it wasnt even OUT... you couldn't even SEE it... i hadn't even SMOKED it too recently but it just stank like hell and so he knew.. and then i was fukd.... cuz also it wasnt my car... which meant i didnt have the insurance.. which is a whole nother ticket... it was fukd up.. .

K Ashes here's the deal. Now US law is a little different than Canadian Law but here's the jist of what I got taught on US Law. First off 40 grams of weed if individually packaged can be construde as possession with intent to distribute. If tis is what they are charging you with and you have no other criminal record you will most likely get off with probation and community service hours. If you have a prior criminal record which has anything to do with narcotics even a simple posession of a joint you could face charges of 3 -5 years in prison. Now with that said weed is a hard sell in court these days and the chance are very slim you will recieve full penalty. 40 Grams of weed in Canada will get you 1 - 2 years in prison no questions asked. It really depends on the arresting police officers deposition and exactly what he has submitted as verbal/factual evidence. Now your other option is to basically say you had borrowed the car and was unaware that there was drugs in the vehicle. They'll see right through it but they can't prove that you where aware of its presence. The down side to this is they will come after your boy friend and he will get charged. being that they would have to do the extra work the possesion with intent is what they will most likely go after. You need to talk to a public defender to find out local/federal details on this satute. What was the exact amount of weed found in your vehicle? The answer to this question determines everything.

it was all in one jar tho so they cant pin me for intent ta distribute...
and 40 grams or less is a misdemeanor, so its more likely that i will get probation.. but i wonder for how long.. like .. ugh.. i dont know.. i been thinking about this so much it makes my brain hurt.. because i dont have n e prior offenses cept 1 when i was a minor, and i did diversion, so it shouldn't even be on my record... i had a lil bit less than 1/4.. say about a 2gram joints worth less... This is your first offense? I think a minor possesion charge will see you with either a conditional/absolute discharge or a small fine, no jail.
When are the cops going to leave Maryjane alone? Getting up at 7am for court sux, I'm going for parking tickets tommorow! Rrrr..
