Traffic Court

So I'm going to traffic court for my first time tommorow morning to dispute my "failing to yield" tix. Has anyone been before? what will they ask?
Right after my accident took place I called the cops, because the driver of the other car was freaking out on me, and I wasnt sure if my car was driveable, and it being my first accident I was upset and didnt know what to do. The cop asked me what happened, but I was so upset all I could realy say was " I didnt see him" she then decided to give me a $140 ticket. (which she said she didnt want to do) So basicaly my argument is that the cop wasnt even there at the time of the accident, and I was the one that called the cops because of the circumstances, yet I get a ticket anywase!
Does that seem like a good argument? I need all the advice I can get! Thanks!!!!!!!

i'm pretty sure you need to prove how you didnt fail to yield.... say you were in shock or something at the time of the incident... what was the icbc ruling of who was at fault?

It was my fault. Cause I was making a left turn and he had the right of way. The day of the accident was very rainy and stormy. where i was making the left turn there is a sharp corner. I look both ways and shoulder checked and then made my way into the road, as im turning I look to the left and I see a car and....smack! I was almost finished turning too.
Also, it was a school zone, he must have been zipping down the hill.

say that you proceded with proper caution and the only reason the accident occured was because the other person was speeding
that would be something good to say
diagrams i heard REALLY work well

tell me how this goes... i got a few in a month or so
including a $450 speeding ticket....sigh

According to Akeel its too late im fucked!
Lesson learned-Don't sign papers (addmitting that your guilty), because your upset, distrought and the cop hands u a pen! :(

heres my advice.make sure u read the ticket and go to the courthouse IN THE RIGHT CITY. my appointment was in richmond and i went to ladner.
now i lose my license, again.

well, looking at the papers they sent me in the mail, it says that I am disputing the allegation, so I guess I'll give it my best shot, also i was wrong. ICBC never found me guilty because our insurance isnt with them!

The results are in: So going in there today I was goning to proceed with fighting the tic, as I had planned, but unfountuantly the fucking retarded driver of the other car showed up as a witness, as well as the officer. before the case the officer told me I should plead guilty to the offences becuase I wouldnt have a chance as well as the judge can increase the amount in the fine, if he/she choses to do so.
So being kinda nervous I decided to plead guilty and ask for a reduction in the fine. The jugde was soooo nice!!! she knew exactly where my accident took place and addmitted herself that it was a hard corner! She also read the motor veachial act for my alligation of failing to yield, and it didnt totaly fit to what took place in my accident, which she also pointed out! Damn! I probably could have won the case, if I had a bit more time to prepare! Also I didnt want to give that stupid mofo other driver the chance of saying anything on the stand. so hahahaha he came for nothing!
oh well, I guess I took the safe way out and my tic is only $75. And I have till April to pay it.

you could have easily won - in the motor vehicle act as long as you yield the right of way and then precede when it's safe to do so it then becomes the other persons fault. Since there was no actual evidence that you didn't yield the right of way to oncoming traffic there's no way they could have won - especially since there were no other witnesses. I fought mine and won - but at least you showed up though and $75 is better than $140.

That's like the time I got a $29 fine for riding my bike back from 7-11 in Wvan without a helmet. I protested it, only to pay $12 :kam:

But I still have a seatbelt fine that I got in Golden. $96. :finger: :finger:

getting it reduced by that much is pretty good
thats what i hope for when i have to go to court

i hear crying poverty and you cant afford the ticket works semi-well too

say.. i cant afford this ticket i have to pay for school or something
