Icbc!!!!argh
I like so many people recently was involved in a fender bender. (Actually more like a rubbing of bumpers) I was leaving a friends apartment out of his underground parking lot. As I was inching out of the driveway to see down each way of the alley a car flashed in front of me. I applied my brakes and came to an immediate stop where my bumper rubbed up against the other driver’s car. (I should give you a little background information on the lane in question. As many lane ways in the greater Vancouver area this one has become a short cut for many drivers to save the two car lengths in traffic) I have seen this similar situation happen several times in the past in this same alleyway and was not surprised that it happened to me and my car. The only time I was surprised was when I placed the call into ICBC. ICBC explained that in the Motor Vehicle Act it states “any vehicle encroaching on a laneway/roadway that comes in contact with another vehicle is immediately at fault” and that the accident would be 100% my fault. I explained that I was coming out of an underground parking and that without creeping into the alley there is no way possible I would be able to see down the alley to enter the roadway safely and that it’s strange that the other driver could see my car but I had no way of seeing them. I was abruptly informed that this is the LAW and that is that. I asked that a more formal investigation be done on their behalf as I felt there was circumstances involved that I felt assured me that it couldn’t be my fault in anyone’s rational eyes. I was then informed of another example of this idiotic law. The ICBC person told me that if in a parking lot you are backing out of parking stall and you can not see either direction no matter what speed or how aggressive the other car is traveling the person slowly backing out of their stall is 100% at fault. Again I could not believe the words I was hearing. So I said for an example what I should do in this scenario is to pay out right the damages to the other vehicle involved in my accident which saves me from losing my deductible and to get my car fixed I should head down to the local parking garage and wait for someone to start backing out then ram their rear end with my car. This way I get my car fixed and it’s 100% the other persons fault. The ICBC rep answered well that would be dishonest! And yes I agree it would be but how is it that ICBC is keeping me from not being dishonest. This whole situation stems back to a greater issue with ICBC. When you have a monopoly on a market where if you wish to drive you MUST have ICBC insurance there is no incentive on behalf of the insurance company to fight for your best interest. Companies in the US like “Microsoft” are getting split apart because they are perceived as having a monopoly and here we are with a government run agency doing the same thing. This problem doesn’t happen in other countries/provinces because insurance agencies fight to defend their drivers and their premiums. Who does ICBC care about other than themselves? It amazes me how a company that uses a slogan of “Use your road sense” aids in protecting bad drivers and penalizes good drivers. No doubt about it, it’s appalling and something’s got to change. i would have to side with icbc anyway, its on the onus of the person coming out of the stall to make sure that no one is in the way. |
