Banks cashing checks BEFORE the PostDate!

I go to look up my balance this morning on my already suffering bank account to find that a check dated for Sept. 5th has been put through! It puts me in overdraft and then the bank tells me that they are gonna charge me for bouncing a check, odraft charge, etc....

What a fucking pain!!! Now I have to go through all the shit of phoning the bank and telling them to retract all the fees and gimme my money back cuz the check was dated.... I mean really, how hard is it to look at a date on a check? Especially the tellers.. isn't that their job!?!?!?!

Yeah...I think technically that is illeagal...(I will stop talking out of my ass here because I really don't know anything about it.)
But doesn't a check basically have a date on it saying that on THIS DATE they can go into your account and extract money...it is illegal for anyone to access your account without permission...its; like the check is permission but only after a certain date so they went in there without your consent

^ that is true - but banks recomend you don't write post dated cheques anymore - cause cheques are so archaic in comparison with the systems in place now - Everything is processed electronically so date checking is not what it once was - there is simple too many items for everything to be looked at

so the onus now is on the payee to be honest and not deposit early - I fthe item is brough to a teller to cash - the teller should be checking the date, but if the item goes in through the bank machine , it goes through an automated process where usually only large items are double checked for authenticity - otherwise that 's all bank staff would ever be doing

As soon as it is determined a post dated ck went through your acct. you aren't responsible for any of the fees because a ck is like a contract and that contract is not valid until the date stated

I predict that cks won't be around many more years - already banks don't make counter cks anymore nad with direct deposit and debit, and all the plastic cks aren't as widely accepted as they once were -

Shawn - it is uber lame this happened - when i worked at a bank i dealt with this alot - I know it sucks that you should have to watch out for this shit ...but make sure all the fees come back, and make sure they don't bounce the ck and have that go on to your credit history ( if you are out of beer money - you know you can always have some of my beer :) )
