Legal Advice/help, anyone, please!

Okay, so the story is a friend and I got screwed over at the border. Driving home from the Cloverdale Rodeo, I am passed out in the passenger seat obviously because I was wasted. My friend takes a wrong exit, not really knowing the area. So we end up at the border. I have 23 caps in my bag that I had picked up that day for a camping trip the rest of the weekend. Border cop searched and finds it.

At the end of the whole process they only thing they gave me was a Seizure Receipt for my friends car under my name, because I said the drugs were mine. So I had to pay $880 (street value of the drugs) to get the car back. never got any paper stating I had any charges against me or that I had to make any court appearances. What is the deal here? I dont know if I am charged..like should be getting something in the mail or what.

Ive asked a few friends who have gotten into trouble similar to this and they said that it sounds like the payment of $880 was my punishment. But I donno...Im just getting all the advice I can. So anyone here got any for me?

I think he's right.

Cops are required by law to serve you with notice of some kind... a ticket or something.

At worst it's a blip on your record that you got given a 24hr impound or something like that. No criminal record, no fine or anything like that. Cops have a certain statute to press charges, and honestly they wouldn't press charges on you with 23 caps, they would sooner try to press a deal on you to sell out your dealer.

That being said, 23 is above the possession-with-intent line, isn't it? Be thankful all you had was a fine, you could technically net jailtime with that.

^ I know of someone else who accidentally crossed while drunk...didn't actually go through the US customs but when he turned around ended up having to go through Canadian customs and explain to them (drunk no less) that he hadn't actually been in the States.

In the dark, maybe a bit drunk, and not familiar with the area...yeah I could see it happening. Dumb, sure, but not beyond comprehension.

Thats exactly it. They thought we were Americans trying to get into Canada, when all we were doing was following the instructions of the first border cop where to turn around. It was just a simple mistake...I dont see how people cant see this happening, why would I make up any part of my story if I want real advice anyways?

the same thing happened to my sister. she got denied going into the US because she'd been staying there for too long, so they made her turn around and they were hassled on the way back into canada. her friend cried and they got out of a strip search though.

he best legal advice i can give you is that you should call a criminal lawyer.

but its likely you got off, typically they'd give you a court date before they let you go.

i still dont get how anyone gets lost and goes over the border. the large bright signs that depict the border wait times would be the first clue. all the signage before the last exits/roads. the enhanced security. all clear indications of the border.

What baffles me about this thread is that you got caught with an amount of illegal drugs enough to be considered trafficking, and you're complaining about an $880 ticket. You could easily be in jail, consider yourself lucky.

Edit: Also consider yourself lucky that you weren't caught with the drugs in the US. You'd be royally fucked.

I really don't think she's complaining, just wondering if she really did get off this easily or if she should expect things aren't all said and done.
