"Utter threat and mischeif"
Does anybody know the maximum penalty for UTTER THREAD AND MISCHEIF, in Canada?
2 seperate crimes. Utter threat Mischeif Can anyone who knows law very well, tell me what the MAXIMUM penalty is for these 2 crimes? Either or.. preferably both.. The minimum would be beneficial to know as well. ..? This is for a friend who is locked in Jail and I'm affraid of what is gunna happen to him. :( Save the stupid blah blah jokes.. either give me an answer, or I"ll delete / copy / paste the same thread again to erase your post. Thanks.

yeah.. what is the penaltie for uttering threats.
some guy called me at work and left a voicemail saying that if I call him or something, again, he's gonna come down to my work and beat my ass down. and start a war. But he didnt say who he was so I could stop calling him............... fucking funny voice msg tho.....

Hm.
See the thing about uttering a threat can be broken down into two different kinds of offenses depending on the nature of the threat. If the threat is pertaining to causing bodily harm/death to another person, depending on the nature of the threat you can be looking at 18 mos probation to imprisonment of no more than 5 years If the threat is pertaining to causing harm to property then you're looking at either probation, a jail term no more than two years or you could be guilty of a summary conviction. Bottom line is that a threat to someone's life is taken a little more seriously than a threat to someone else's property, but if the bomb threat was pertaining to some kind of public place then you could be looking at being accused of threatening to cause bodily harm to other people. Keeping in mind your friend is young and has no priors, that could probably help him...but, you'd really have to take into consideration how many people this silly bomb threat could have pissed off. In today's world, they're a lot less forgiving of things like that even with no priors. Bottom line is, you'd have to be pretty stupid to pull off a bomb threat anywhere because chances are they're going to be pretty unforgiving when you're caught. The chances of your buddy getting a record can really depend on the context of the situation. But really, you make your bed...
