Copyright deal could toughen rules governing info on iPods, computers
Vito Pilieci , Canwest News Service
Published: Monday, May 26, 2008

OTTAWA - The federal government is secretly negotiating an agreement to revamp international copyright laws which could make the information on Canadian iPods, laptop computers or other personal electronic devices illegal and greatly increase the difficulty of travelling with such devices.

The deal could also impose strict regulations on Internet service providers, forcing those companies to hand over customer information without a court order.

Called the Anti-Counterfeiting Trade Agreement (ACTA), the new plan would see Canada join other countries, including the United States and members of the European Union, to form an international coalition against copyright infringement.

I read this in the paper, probably won't get passed now.

However there is a chance it will, and this is just an over all terrible idea.

I bet Geist is all over this,

here's the white paper: IP Justice › News Archive » IP Justice White Paper on the Proposed Anti-Counterfeiting Trade Agreement (ACTA)

Apparently this has been discussed in private for sometime now.

Yeah, and how exactly are they intending to prove that I didn't legally purchase the copyrighted material on my computer and rip it for personal use?

Canada was trying to bring in DMCA like copyright rules that would make it illegal for you to copy for personal reasons. I believe it was something to do with the "Device-shifting" provision. The bill was about to be tabled but we stuck it to Prentice and he withdrew the bill. Not sure on the updates since then.

edit: man are u reading some of this shit? It's a NAFTA like trade deal that could go over the courts and even let border guards search your electronic devices "ex parte" or without a lawyer. ISP's would have to give up our personal information

Yeah, well, it's not law now and it probably won't be as long as the cons have a minority. So Fair Use is still a perfectly valid argument.

Still completely impossible to enforce, and if they tried it would become a public relations nightmare. RIAA has already lost in the hearts & minds of the people, and they've been faced with setbacks stemming from their shady practices in trying to enforce their copyrights.

Information is free. That's not a political position, it's a fact. The only way politics comes into play is through one of the worst cases of government denial I've seen.

They've been trying to control copyrights online for over 8 years now and the more they try the more successful the pirates have become.

They shut down Napster and then we had Audiogalaxy. They killed that we all moved to Kazaa. That got shitty so everybody went to soulseek. Then bit torrent got popular and we saw oink. then oink died and now stmusic has all the pre-releases you'd ever care to want. Point is there will be another, and then another, and then another.

Information is free, and there's nothing anybody can do to stop that. All they can do is sue randomly selected people who can't afford lawyers and essentially committing extortion. Well even that isn't working... one guy had his case dismissed and even convinced the court to make the RIAA pay his lawyer fees. Another court case was dismissed because the tactics they used to identify the filesharers were illegal - unlicensed investigators, breach of privacy without a warrant - hey, only the USG is allowed to do that!

I know it'll have a hard time passing much like the other bill. I just get all uppity every time they try to pull this bs by minimizing the public role in policy decisions. It's been a constant battle so people have to keep their eyes open.

Tories eye $500 fine for illegal downloads

David George-Cosh, National Post Published: Monday, June 02, 2008

The federal Conservatives are set to introduce new copyright legislation as soon as this week (apparently tomorrow Wednesday June 3rd, according to other news sources) that will include provisions to target users with a $500 fine for all illegal files transferred online, a move that legal experts say could see Canadians sued for hundreds of thousands of dollars if found guilty of infringement.

Multiple sources familiar with the matter have told the National Post that one of the provisions in the government's updated Copyright Act of Canada will include a fine for each "personal use download" found to be shared online through peer-to-peer software programs.

Other provisions in the bill, which is said to be tabled to the House of Commons tomorrow afternoon, will include measures to make it illegal to unlock cellphones or copy music from protected CDs to iPods as well as making it illegal to copy "time shifted" shows onto personal video recorders if flagged by broadcasters.

The current Copyright Act charges a maximum $20,000 fine for each infringed material, but experts say the act was designed primarily for commercial cases and not to accommodate how digital copyrighted files are handled by individuals.

The push to update the Copyright Act to reflect the current digital climate has been an eventful -- yet slow -- campaign. It has not been amended since 1997 although prior attempts to draw it in line following the ratification of the 1996 World Intellectual Property Organization Performances and Phonograms Treaty have failed. Another attempt by the Conservative government to introduce updated copyright legislation this past December failed following an outpouring of protest by grassroots organizations across Canada over fears the bill would fall in line with harsh U.S. copyright laws.

Still not gonna fly. Who's gonna support this in the house?

I see the government collapsing soon around this type of legislation. Pray we don't end up with a conservative majority after that.

wow. they dont even want us ripping completely legal and purchased music onto a personal music device. thats fucking terrible. if this shit flies, the only thing i can see happening is people completely stop buying cds altogether and only purchase music online.
i really doubt this will fly at all. and im disapointed in the cons for trying to pull this shit. im pulling my vote from these dumbasses. only reason i gave them my vote last time anyways was to hope they would pull the completely useless billion dollar per year gun registration laws that ~still~ dont work right.

This isn't a bill that would cause an election though if defeated. It's hardly mission-critical.

I can't honestly see that kinda rigorous searching becoming common place. The cost to train boarder staff alone would be hugely prohibitive, especially considering how many reasonably simple methods there are to hamper such searching.
