MADD shocked and upset with Liberal idea to decriminalize drunk driving
VANCOUVER/ CKNW (AM980) -- The President of the Greater Vancouver chapter of Mothers Against Drunk Driving calls Coleman's proposal "shocking and very upsetting".
Rich Coleman wants to cut down on the amount of court time spent on drunk driving trials. President Helen Hoeflicker says these are seperate issues. Hoeflicker says that may be the way the courts are running, but prosecuting drunk drivers is a public safety issue, not a matter of court efficiency. She says thousands of people are killed and injured each year. I have been Djing in Clubs accross the world for over 14 years and let me tell you I have seen way too many people leave the bar and get in their cars when I now that it ain't a good idea but the law doesn't allow you to intervene. Drunk drivin should be based on a scale:
Over a certain limit equals the penelty over the next limit equals this penelty and each penelty should be double for repeat offenders. No need for court:::: If they blow a level and a blood check confirms their intoxication then you are done and shouldn't even have to go to court. G |

did you just take poli sci 100 or something? the point i was trying to make is that even though we do not have to provide a breath sample (according to the charter), if you do not then u get slapped with "failing to provide a breath sample" and an automatic 24hr (i believe but i'm not positive). So your charter has effectively done nothing because its been over ridden by the criminal code of canada. |

The Charter being overridden by the criminal code??----->Impossible!!! its the other way around! the Charter was established to provide judicial checks on government legislation The Charter overrides the criminal code in every way shape or form. And yes I am currently taking law courses at SFU |

in theory it does...but go tell that to the people that refuse to provide a breath sample and end up with a 24 hour suspension.
where is the charter now? btw i have my crim degree and am in law @ dalhousie (taking a break this semester) *edit - posted under wrong account* yeah at first i wanted to do criminal but now i'm going to focus more on contract and tort. |

Thank god for the Canadian Charter.
From what I've heard and read so far, the government is planning to make the penalty stronger for impaired drivers. I think there idea of 3 months without your license, instead of 24hrs is a great idea. |
