Assault thrown out -- sleep sex blamed

TORONTO, Nov. 30 (UPI) -- A Toronto man has been acquitted of sexual assault charges, as medical officials said he was asleep at the time, with a disorder known as "sexsomnia."

Jan Luedecke, 33, met his victim at a party on July 6, 2003, and both had been drinking, the Toronto Sun reported.

The woman, who can't be named, fell asleep on a couch and said she awoke to find him having sex with her. She pushed him off, then called the police.

Luedecke claimed he fell asleep on the same couch and woke up when he was thrown to the floor.

Sleep expert Dr. Colin Shapiro testified Luedecke had sexsomnia, which is sexual behavior during sleep, brought on by alcohol, sleep deprivation and genetics.

The judgment outraged women's groups, the newspaper said.

"This is infuriating. It's another case of the courts not taking a woman seriously, adding yet another list to the list of excuses which men use for sexual assault," said Suzanne Jay, of the Canadian Association of Sexual Assault Centers.

It's happened before...not sure but i think it ruled in the murderer's favour.

i'm a crim student - it's called the 'automaton defence', where someone claims that they were sleepwalking or whatever when the offence occurred and therefore had no idea what they were doing at the time.
doesn't happen very often, but there has been cases where a guy had woken up in the middle of the night, driven to his in-laws and murdered them, but claimed that he was asleep during it and therefore had no intent
there was a case of this regarding sexual assault, with a guy getting super drunk and then sexually assaulting a woman in the wheelchair, however this would rarely be acceptable as they are drunk voluntarily and so the outcome from their actions coud have been foreseen - VERY rare that it will be accepted as a defence - sorry gusto!

its possible, i had a roomy once that every so often nights he would get off his bed grab a pencil then come over to my bed and just stare at me with the pencil in his hand. he didnt know he did it until i confronted him one day. and he even used to say no no in his sleep like he was being disturbed. could only spend like month in that place. lol. it was creepy.

Are you sure it was a pencil? Maybe he just had a really small dick and was whacking off to you while you sleep. I do that every time Flip spends the night :P

one time i took 2 sleeping pills and sleep walked around not remembering and took thge whole bottle... i wound up in the hospital. but i didnt have some excuse like sleepingpillsomia

i dont understand how a person can fall asleep so soundly and not notice someone doing them.. i coulndt even sleep though someone taking off my pants. i agree. she's a slut. she knew what was going on and just pretended to be asleep.

Actually an intro to crim class is where i heard that too :) Crim isn't my area of study though, I actually can't stand it heh. I'm more into poli sci, soci and hist.

ive kinda had this happen once, I was at the bar juiced partying away as you do, this girl i had no interest in was around, then BOOM next thing i know im back at her house making out with her, i like blacked out then came too at her house it was soo fucked up i felt totally disoriantated and wanted nothing to do with the girl. its the only time its happend and it wasnt sleep sex more like sleep makin out :)
