nothing goes on your official record unless you've been charged. they have a file that they keep to themselves for all the other times you've been bad, but not bad enough.

interestingly, i've heard that even if you get acquitted of a charge, it's still on your record. can anyone confirm that?

^ See i think that's bullshit if it's true because if they see you with a bunch of crap on your record regardless if you've been charged or not they are going to treat you differently when they pull you over.

If you have an unconditional discharge (aquittal) or a conditional discharge where you meet the probation requirements then the information is removed from the system in Canada.

That being said it is unknown whether or not the information is removed from the US databases.

So if a US Customs officer asks if you have been ever charged for an offence it is easier to say 'Yes' and explain that it has been removed than to say 'No' and come under scrutiny.

it isn't as if it's not pertinent information. if you have been charged with many crimes, but let off either due to lack of evidence or technicallity, chances are that you might have committed those crimes. if the current situation suggests you might have committed a similar one, the police should know this. or, if you have been in situations where you have acted violently, the police should know, so they can prepare themselves against any eventuality.

if you find that they are profling you because of this, then it's your own damn fault. you profiled yourself. you're just lucky you weren't convicted, and the only record you have is in a private advisory.

(in some big ol' mainframe in ottawa i'm down for obstruction of justice, and possibly civil disobedience. that is, if they even bothered to do the paperwork...)
