who knows anything about law.... PLEASE HELP ME OUT

does anyone fucking know anything about law.... this guy ok, i went downtown looking for a place where i dont need a lease to sign (im 18), found 1, put 150$ down and i was going to get him the rest in 2 weeks, when i planned to move in, so it was the damage deposit ok, and now i found a better place, havent moved in (he told me i had the option too, but there was a fridge, couch, broken door, shit evewhere in my room, cuz they were renovating it) and now he wont give me shit back that i found another place, hes calling it a security deposit, so what the fuck is that?

usually deposits are non-refundable..


was it specifically stated and was anything signed saying it was a deposit?

no, nothing signed, i have a receipt, but like, he said it was damage deposit..... but i didnt damage anything! like... shouldnt ig et it back then?

i'd say your SOL. cancelling notice on an apt. is a definite no no
just like cancellign a doctors appointment, it costs money for him,
cause know he has to find someone else. and the delay costs him money.
that's why he asked for the money in the first place,
to make sure you wouldn't do exactly what you did.

SOL? yah, its on a really bad part of town for one, and its shared accomodation, with 2 crack heads. and when i went in the building to the room i was going to be in, there was drywall everywhere, knife marks in the walls, a couch, and a fridge, all stuff in 1 fucking room

Erin and I have been through you name it with some of our landlords because they're hoes. Cops wont do anything..

but if you want your stuff and you have some form a of ID stating you live there... get a lock smithe. They can get you in there and the landloard has no say.. or break the door down.. they have no say.. just means part of your damage deposit is gone.

As long as you've been living there.. the landlord has no say on what you do to your place untill you move out. cause the cost comes out of the damage deposit.

You have many options.. so excersize them.

don't be affraid.. cause you'll regret it later and end up with half your shit gone.

Trust me.
50% of my stuff was taken by my first landlord, cause she needed money for crack.

k, thanks dude, but i have no shit in the place, i NEVER MOVED IN. but i do have the keys right now. that shit in that room was not mine! they didnt move it, so technicaly, i can go cause shit? like, i didnt pay for 1 months rent.. i paid 150$ for the damage deposit, and he told me i can move in and pay him the rest of the money this friday. i told him this and that... and i went there the other day and there was this dumb ass native old lady smoking a j... i could use taht against him saying i dont want to be around drugs... couldnt i

oh ok.. I get it.

you just want your damage deposit for somewhere you never lived.. but were playing to live in but changed your mind!?

Well tequenically.. you have to move in... for the month.. give your months notice then you can move out. but you still have to pay rent for that month.. ummm.. and if YOU haven't done any damage to the place.. I see no reason for you not getting your money back. But landlords can be bitches... and not give it back to you....

But if you feel your security and what not is not good there.. you can use that approach, but they might make it so you will stay like.. add another lock to your door.. or something like that. but if you do go.. they can sue you. and I doubt you'd want that.

But I mean really.. before you go a give your money away...you shuldnt do it waaaaaaay in adavance.. do it like the day before you move in and shyte. gotta becarefull with shit like this.. but I guess you gotta learn through experinece.

thanks a lot, youve been really helpful, but yah.... ill figure something out, hes not even makingme stay for 1 month... thers no rental agreement, im going to try and get like 50$ back, like anything pretty much, i have like no food t il friday, so thats why

never mind the law, stick to ethics....he's not screwing you by keeping your deposit, you're screwing him by saying you'll rent the place and then changing your mind. now he'll have to go put it back on the market, find another tenant. advertise again, whatever, etc...it may have been a shithole, but by you've probably fucked him around $150 worth already, so deal with it.

I'm pretty sure that since you're 18 a verbal contract means nothing. Technically, until you're 19 you have to have a parent/guardian co-sign anything legal like that. Sooooo technically, you *should* get your money back, but you prob. won't.

I'd agree with Auto - you did screw the landlord by changing your mind at the last minute and I highly doubt you're ever going to see your money back (and it's justified).
