there's an old english case I studied in criminal law. an african kid was walking down the street and these two white kids started throwing rocks at him till he bled, while making racist comments towards him. the african kid went into a rampage and killed one of the white kids. murder is never alright in my opinion. but depending on the situation and the amount of shit a person is put through, I think the defense of provocation should be certainly entitled. why should a person be stigmatized with the title of a "murderer", carrying with them the most severe penalities for something that doesn't equate with an unprovoked killing by a "true" murderer? I certainly wouldn't want to put this african kid in the same league as say, a man who murders his wife to collect insurance money.
