so i run into an ex coworker and ask her how shes doing
not so well...
her husband left her 10 months ago and so she started seeing this regular that I know (always really liked him, little bit weird but nice) so anyways 2 weeks ago she finds out from a friend that he is apparently hiv positive...so she confronts him and he admints that he has it and he didnt tell her because he didnt want her to get hurt! Not to mention, they had unprotected sex twice..and she went to the doctor but she won't find out the results for 3 months because of the incubation perioud...
WHAT A HORRIBLE human being...that is fucking disgusting and I think she should sue him

There is a legal precedent that has previously been set in cases like this. The hard part will be proving:

A. That they haven't slept with anybody since
B. That they weren't previously HIV positive
C. That they had no knowledge of his HIV

I don't fuckin care if the original person was male or female who ever had HIV. The fact of the matter that it comes down to is moral's and ethic's. Lets get real here... Her husband "Left" her 10 months ago.... Thats less then a year... So what right after he left her she found this new guy right away?.... Sounds fishy to me since the claim that "HE" left her.... Marriages can be going bad for years before one leaves the other - I know people whose parents had been sleeping in seperate rooms for more than a decade. I don't think she's wrong to have slept with someone else 6 months (do the math) after her split. What's more, there is trust involved in a lot of realtionships that involve sex, and therefore if they discussed having unprotected sex and both agreed that they had been tested and were clean he is in the wrong. He is even in the wrong having PROTECTED sex while being infected with HIV because condoms do not guard 100% against the HIV virus. They lower the risk of it spreading, however, the virus IS small enough to fit through the fibres of latex condom.

In terms of her rights, Courtney, I'm pretty sure that right now they are trying to pass laws that will ensure that people who knowingly spread HIV are dealt with in the legal system.

You'd think in this day in age people would be alot more careful especially with the amount of diseases that are out there. Perfect example... public toilets...STD's can be easily transmitted. Debates like this are why I think it's not prudent that chicks should always carry condoms.

I'm not saying guys shouldn't, just that in the interest of PROTECTING YOURSELF, it's just safer. Then if the guy gives the "I don't have one" game, you're ok.

Sucks for her, and she's undoubtedly going to go through a lot of emotional turbulence for the next little while. But it's not like nobody knows about what a wonderful invention condoms are, and it's not like people are unaware that there are plenty of STDs out there - not just HIV.

Kudos! I think she's right. He purposefully went out there and spread the HIV disease to an individual after he knew that he had it. Then she gets tested and finds out she's HIV positive.
