There's a reason they're illegal (zoning restrictions aside, which seemed to be a focus of this article). So who's liable? Ultimately, a person wherever they are is expected to obey the law and behave as a reasonable person should. However, when we enter a premise we often put a certain amount of care into the hands of those around us and in charge. "we are not liable" statements can only go so far, they're not always a "catch all" either. Baaaasically what I'm trying to say is at apex for example, if anyone in charge showed negligence of care, they'd be held accountable. However, apex is huge, and a lot of people there are not following the reasonable person test, and apex promoters must be certain to do all within their care to a reasonable level. Avana and co does a fine job of this...pretty much because they're aware of what can happen if things fuck up. You've got security, medics, and safety of probably more than is needed. I've been to underground parties where the promoter is just as fucked up as the 17 year olds sketching out on the floor. security....what good is a bag check that feels from the outside? So if you've shown negligence in protecting your guests from forseeable harm, you're liable. |

I know what your talking about with the under ground raves with 17 year old promoters, a friend of mine threw such a party last saturday. All I have to say is at least give me a trainspotter who was really tough looking to stand behind me and make sure no one goes up and wants too lift the needle or turn a knob (which happened 4 times). there was a fight right next to me, 2 guys in a headlock stopping around breaking records and such. no one seemed to care, al i could think about was protecting my lady and making sure the sit in front of me wasn't going to get trashed.
i bet this happens to most undergrounds with no security, imagine how much of a fuck fest some of these events would be with no security, let alone the shady area. despite the security and constant RCMP showing up a vast majority are on some sort of chemical, also the second room always smells like pot at riverside and at 5am its not uncommon to see constant joints being passed around in front of the main stage ( i remember guyvers face when he saw it lol). One more thing about drinking. If you are piss drunk they go ahead and let you inside! i once saw this girl puke the shit out in the front of the line up and the security just let her inside gave her some water and turned her loose, i saw her 20 mins later laying in her own vomit on the floor (no event or security company will be named haha). i dunno, just 0.02 of a cent |

The problem is everybody keeps comparing Apex 11 with Apex 1, which isn't really a fair comparison... If you want to find something comparable with Apex 1 go to Soundwave. If you want to find another Magic Mountain it's pretty unlikely that ET Brothers will be the ones throwing it. The only thing that changes is your perception of the party. I think ebbomega brings up a very important point that things ultimately haven't changed. When I was explaining the quality of underground parties I've attended...well, you're right, they haven't changed. Attending those, I knew full well the promoter wasn't doing all they could do to prevent injury and insure safety. But you know what? I didn't really care, and neither did anyone else. Same thing when I drive beyond the speed limit to get somewhere quicker - I make a conscious decision to weigh the pros and cons of being personally negligent.
The parties are pretty much the same, although peoples music and drug preferences have seemed to modernize. More agreement with ebbomega, it's perception. The last underground I went to I thought was really shitty, yet everyone on FNK all "big upped" it here the day after. I thought everyone was an idiot for liking it, and boom, my perception changed. It was really the same party that I would have loved 5-6 years ago. |
